Is Stay-At-Home Order Unconstitutional?

     The Stay-At-Home order might seem like a no brainer for all of us closely following the pandemic as it has proven in numerous places around the world to "flatten the curve", but to the few people living in the Panhandle of Idaho this Stay-At-Home order violates the Constitution.  Idaho now has a greater infection rate per capita than California, so the Governor made the call to shelter in place. For some context, most people living in the northern part of Idaho tend to believe that less government is better than more, and to them they believe that the government can't take away their constitutional right to assemble (1st Amendment). 

     Following the shelter in place order some people now are planning on rebelling against the Idaho Governor's order. Aamon Bundy, who is known for armed take over of an Oregon Wildlife Refuge, is urging people to attend mass gatherings for Easter Sunday. A Idaho county Sheriff is also urging people to continue on with their normal lives and business if they feel healthy enough to do so.

     Now I ask you guys, do you believe the Stay-At-Home Order is Unconstitutional?

  1. This was a very interesting post and after reading it, I believe that the Stay-At-Home order is constitutional because everyone is a sort of public danger to those around them, which takes priority over their right to assemble.

  2. I agree. Since the president is also able to use war time production powers for ventilators, the U.S. is 'at war' with COVID-19. During war, there are usually restrictions to freedoms in order to further the needs of the country.
